The Men’s Wearhouse, LLC – Official Rules
No Purchase Necessary to enter or win. The purchase of any good will not increase a participant’s chance of winning. METHOD OF ENTRY IS FREE. This Sweepstakes is intended for participation in the United States of America. All federal, state, local, and municipal laws apply. THIS SWEEPSTAKES IS Void where RESTRICTED OR prohibited BY LAW.
Sponsor
The Men’s Wearhouse, LLC, 5601 Arnold Rd., Dublin, CA 94568 (“TMW” or “Sponsor”).
Sweepstakes Period
TMW’s 2025 Wedding Sweepstakes (the “Sweepstakes”) begins October 1, 2025, at 9:00 AM Pacific Standard Time (PST) and ends October 31, 2025, at 11:59 PM PST (the “Sweepstakes Period”). Eligibility for entry into the Sweepstakes will cease at the applicable time and date, and all entries received thereafter will be considered disqualified and will be ineligible for participation. If Sponsor does not receive your entry for any reason, or if your entry is not entered correctly, the entry will be invalid, and you will be ineligible to participate or win. Sponsor’s computer will be the official time-keeping device for the Sweepstakes.
Who May Enter
Only Eligible Participants who comply with all terms and conditions of these Official Rules are eligible to enter or win. For purposes of this Sweepstakes, “Eligible Participant(s)” solely means:
- lawful permanent S. residents (except Rhode Island) and the District of Columbia at the time of entry;
- who reside in the continental U.S. (except Rhode Island) at the time of entry;
- who are eighteen (18) years of age, and
- Engaged (a partner, as part of an engaged couple), at the time of entry.
Each Winner (defined herein) must provide a valid U.S. address to receive their Prize (defined herein). Sponsor does not warrant that this Sweepstakes is valid in any particular jurisdiction. Participants of jurisdictions where this Sweepstakes is prohibited are ineligible to participate in this Sweepstakes. Employees, agents, or Representatives (defined herein) of Sponsor and its subsidiaries, parents, affiliates, advertising and marketing promotion agencies, and their immediate family members (defined as a person’s spouse, parents, children, grandparents, and/or siblings, regardless of where they live), and/or persons living in the same households of such employees, whether or not related, are not eligible to enter or win. Participation constitutes the Eligible Participant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Sweepstakes. Winning the Prize is contingent upon fulfilling all requirements set forth in these Official Rules.
How to Enter
During the sweepstakes Period, you may enter the Sweepstakes through one of the following methods:
Method #1
During the Sweepstakes period, Eligible Participants must 1) Enter their name and 2) Enter their email and 3) Enter their wedding event date (Day/Month/year) into the applicable social media web form. Limit one (1) entry per Eligible Participant.
Method #2
During the Sweepstakes period, eligible participants must 1) Enter their name, 2) Enter their email, 3) Enter their phone number and 4) Enter their planned wedding date into the applicable menswearhouse.com web form. Limit one (1) entry per Eligible Participant.
Method #3
(Alternative method of entry): On a 3”x5” piece of paper, handprint your full name, complete postal address, email address, phone number, planned wedding date (MM/DD/YYYY) and include the following sentence: I have read and agree to the Wedding Sweepstakes Official Rules. Mail in your entry with a properly stamped envelope to The Men’s Wearhouse, LLC, Attn: 2025 Wedding Sweepstakes, 5875 Arnold Road, Suite 250, Dublin, CA 94568. Mail-in entries must be post marked by October 31, 2025, and received by November 7, 2025, to be eligible for a drawing. Limit one (1) entry per stamped outer envelope.
By entering the Sweepstakes, Participant is providing Participant’s information to Sponsor. Sponsor is not responsible for, and shall not be liable for late, lost, misdirected, unsuccessful, or illegible entries for any reason. Sponsor reserves the right in its sole discretion to reject any entry for failure to comply with these Official Rules.
Prizes
Sponsor will award the following prize(s) (each a “Prize,” or collectively, the “Prizes”) as follows:
One (1) Winner shall receive one (1) $5,000 check, made payable to the Winner.
The reporting and payment of all tax liability incurred by the Winner as a result of the Sweepstakes, including but not limited to federal, state, and local income taxes, is the sole responsibility of the Winner. All federal, state, and local laws and regulations apply. The Winner is solely responsible for all fees or costs associated with the Prize received, regardless of whether it, in whole or in part, is used. The Winner may be required to complete certain tax documents for the value of the Prize and return them to Sponsor. The Prize is awarded AS IS and WITHOUT ANY WARRANTY OF ANY KIND, expressed or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. The Winner may waive Winner’s right to receive the Prize. No substitution of the Prize will be permitted, except by Sponsor, which may substitute a prize of equal or greater value if the advertised Prize becomes unavailable.
Odds of Winning
The odds of winning will be dependent upon the number of eligible entries received.
Winner Selection and Notification
One (1) Winner will be chosen by random selection. The Sponsor’s decision is final and no correspondence will be entered into relating to the Sweepstakes’ result. The selection will take place after November 7, 2025, and the potential Winner will be notified on or before November 14, 2025, via email, and must (1) respond to Sponsor and acknowledge the notification within twenty-four (24) hours from when the notification was sent by Sponsor; (2) complete and return a Sweepstakes release (the “Release”) within forty-eight (48) hours from when Sponsor sent the initial notification (collectively, the “Winner Requirements”); and (3) send photo as proof of engagement. If any potential Winner does not or cannot meet the Winner Requirements, the Prize may be forfeited, and Sponsor may, in its sole discretion, disqualify said potential Winner and award the Prize to the potential runner up. Sponsor is not responsible for, and shall not be liable for, lost, misdirected, or unsuccessful efforts to notify the potential Winner, for any change of the potential Winner’s contact information. Upon Prize forfeiture, no compensation will be given.
Within sixty (60) days of Winner’s completion of the Winner Requirements, the check will be delivered to the postal address provided by the Winner. Sponsor is not responsible for items delayed or lost during shipping, however, tracking information will be provided.
Each potential Winner will be subject to all requirements set forth in these Official Rules. EACH POTENTIAL WINNER IS ALSO SUBJECT TO VERIFICATION, INCLUDING VERIFICATION OF AGE, AND RESIDENCY BY SPONSOR WHOSE DECISION IS FINAL AND BINDING IN ALL MATTERS RELATED TO THIS SWEEPSTAKES. A PARTICIPANT IS NOT A WINNER OF THE PRIZE, EVEN IF THE SWEEPSTAKES SO INDICATES, UNLESS AND UNTIL THE PARTICIPANT’S ELIGIBILITY HAS BEEN VERIFIED. SPONSOR WILL NOT ACCEPT EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. SPONSOR HAS THE RIGHT, IN ITS SOLE DISCRETION, TO DISQUALIFY ANY WINNER AND/OR REMOVE FROM ALL SPONSOR MATERIALS ANY INDICIA OF A WINNER WHO COMMITTED AN ACT OR HAS DONE ANYTHING WHICH MIGHT BE REASONABLY CONSIDERED (A) TO BE IMMORAL, SCANDALOUS, OR OBSCENE; 0R (B) TO TARNISH, DAMAGE, OR OTHERWISE NEGATIVELY AFFECT OR IMPACT THE REPUTATION OR GOODWILL ASSOCIATED WITH SPONSOR OR ITS BRANDS.
PUBLICITY; INTELLECTUAL PROPERTY
Participants, upon submission of their entry to the Sweepstakes, hereby irrevocably grant to Sponsor, and each of their licensees, successors and assigns, the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the entry submitted as part of the Sweepstakes, and all images, text and materials depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised (including, without limitation, CDs, streaming media, film, television, videocassettes, print, interactive devices, mobile media, Internet and on-line systems, digital billboards), throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it. Sponsor, and each of their successors, assigns and licensees, will have the right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited, multiple-level sublicenses. Without limiting the foregoing, Sponsor will have the right to use the entries submitted as part of the Sweepstakes, and all images depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose.
Participants hereby forever waive and relinquish all so-called “moral rights” now or hereafter recognized in connection with entries submitted as part of the Sweepstakes. It is Participants’ responsibility to ensure that Participants’ submitted images do not infringe or violate the intellectual property rights or other rights of any third party or any laws. Participants’ images must not contain brand names, copyrighted material or trademarks, other than those owned by Participants or Sponsor. Participants agree that Sponsor shall have the sole discretion in determining the extent and manner of use of entries and are not obligated to use any entry. Participants agree not to issue any publicity concerning Sponsor. Participants agree that neither Sponsor nor their agents shall be responsible for returning or preserving of the entries submitted. All entries that are posted on Sponsor’s website, blog and social media may be available to be viewed by anyone with access to the Internet.
Limitation of Liability
By entering the Sweepstakes, all participants agree to these Official Rules, all eligibility requirements, and all decisions of Sponsor. BY ENTERING THE SWEEPSTAKES AND/OR ACCEPTING THE PRIZE, ALL PARTICIPANTS AGREE THAT THE SPONSOR, FACEBOOK, INSTAGRAM, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”), WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS FOR ANY AND ALL ACTIONS, CAUSES OF ACTION, SUITS, DAMAGES, DEBTS, CLAIMS, INJURY, LOSS, OBLIGATIONS AND LIABILITIES OF WHATEVER NATURE, KNOWN OR UNKNOWN, WHETHER INTENTIONAL OR OTHERWISE, ARISING OUT OF, DIRECTLY OR INDIRECTLY, THE PARTICIPANT’S PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE, CLAIMS BASED ON INTELLECTUAL PROPERTY RIGHTS, PUBLICITY RIGHTS, PRIVACY, OR DEFAMATION, OR CLAIMS BASED ON THE NEGLIGENCE OF SPONSOR. The Released Parties are not responsible if Sweepstakes and/or Winner’s event cannot take place or if any Prize cannot be awarded due to acts of war, natural disasters, weather or acts of terrorism, epidemic, pandemic, or any other acts or events beyond its control. Participants further agree that the Released Parties not responsible for: 1) any incorrect or inaccurate information, whether caused by participants , printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; 2) technical malfunctions or failures of any kind, including without limitation, malfunctions, interruptions, traffic congestion, or disconnections in the telephone network, computer online system, computer dating mechanism, computer equipment, software, servers, providers, or any combination thereof; 3) unauthorized human intervention in any part of the Sweepstakes, including theft, destruction, or unauthorized access to, or alteration of, entries; 4) technical or human error which may occur in the administration of the Sweepstakes or the processing of the entries; or 5) any injury, damage, or loss to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Sweepstakes, or receipt, possession, acceptance, and/or use or misuse of any Prize. Finally, participants warrant and represent that their entry does not infringe upon the copyrights, trademark rights, rights of privacy, publicity, or other intellectual property, or other rights of any person or entity, and that any publication of the entry via various media outlets, including Internet posting, will not infringe on the rights of any third party. Accordingly, participants and/or Winner shall indemnify and hold Released Parties harmless from any claims arising from the use of each participant’s or Winner’s entry.
Disclaimer
If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, pandemic, epidemic, human error or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process , and to cancel, terminate, modify or suspend the Sweepstakes, or any portion thereof. In the event of early termination or cancellation of the Sweepstakes, Sponsor may award recognition to a winner based on the above judging criteria from among all eligible, non-suspect entries received prior to termination or cancellation. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General
ALL ENTRIES (EVEN ENTRIES USED BY SPONSOR PURSUANT TO THE LICENSE UNDER THESE OFFICIAL RULES) ARE THE VIEWS AND OPINIONS OF THE INDIVIDUAL ELIGIBLE PARTICIPANT AND DO NOT REFLECT THE VIEWS OF THE SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to participants.
Sweepstakes Rules and Winner
These Official Rules and the name of the winners may be obtained by sending a self-addressed, stamped envelope to: The Men’s Wearhouse, LLC, Attn: 2025 Wedding Sweepstakes, 5875 Arnold Road, Suite 250, Dublin, CA 94568. within thirty (30) days of the end of the Sweepstakes Period.
Collection of Information
Participation in this Sweepstakes is not conditioned upon the provision of any personal information to Sponsor by any person under the age of thirteen (13) years. If you are under the age of thirteen (13), do not provide Sponsor with any personal information about yourself, including your first or last name, address, phone number, email address, picture, or similar information. Sponsor does not seek to collect, and will not knowingly accept, personal information from persons under the age of thirteen (13) years. All information submitted by entrants is subject to Sponsor’s Privacy Policy accessible at https://www.menswearhouse.com/privacy-policy.
Governing Law and Jurisdiction
Except where prohibited, all participants agree that: 1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court having venue in Alameda County, California; 2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, if any; and 3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the participant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
Third Parties
This Sweepstakes is in no way sponsored, endorsed, affiliated with, associated with, or administered by Instagram, Facebook or Tiktok. Participant is providing its information to Sponsor and hereby releases and agrees to hold Instagram and Facebook harmless from any and all liability, claims, or actions of any kind whatsoever for any injuries, damages, or losses of any kind in connection with this Sweepstakes.
